On the 31st March 2020, NERC issued the Order on the Transition to Cost Reflective Tariffs in the Nigerian Electricity Supply Industry (“NESI”) (the “Order”), which became effective from 1stApril 2020. The Order was issued in response to applications for extraordinary tariff review filed by the DisCos and public hearings with stakeholders and sets out a framework and preparatory steps for transitioning into full cost reflectivity in the NESI

EIGHT UNANSWERED QUESTIONS ARISING FROM THE FINANCE ACT 2019.

The Finance Act, 2019 was enacted into law on 13th January, 2020 with the objectives of reforming Nigerian tax laws to align with global best practices, support small businesses in line with the ongoing ease of doing business reforms; and raise revenue for government amongst other laudable objectives. The Finance Act made sweeping changes to the provisions of the Companies Income Tax Act (“CITA”), Value Added Tax Act (“VAT Act”), Petroleum Profit Tax Act (“PPTA”), Stamp Duties Act, Personal Income Tax Act (“PITA”), Capital Gains Tax Act (“CGT Act”) and Customs, Excise Tariff, Etc. (Consolidation) Act.

On the 3rd July 2019 and the 10th July 2019, the Central Bank of Nigeria (“CBN”) issued a circular on the Regulatory Measures to Improve Lending to the Real Sector of the Nigerian Economy and subsequent circular on the Guidelines on accessing the CBN Standing Deposit Facility respectively. The circulars are aimed at improving Lending particularly to the Real Sector of the Nigerian Economy.
